Understand the relationship before the agreement

RECA's Consumer Relationships Guide explains client and customer relationships, common-law agency, designated agency and transaction brokerage. A buyer client receives agency duties such as loyalty, confidentiality, full disclosure and reasonable care from the appropriate representative. A customer receives more limited services and should not expect advocacy.

Ask the professional to explain which model the brokerage uses and who will be your agent. Do not rely on the casual phrase 'my realtor' after a portal signup, open house or showing. The legal relationship and written service agreement determine the duties, not the amount of time spent together.

Choose the professional before signing exclusivity

Verify the person and brokerage in RECA ProCheck, compare relevant Calgary experience, evidence method, service capacity, communication, conflicts and compensation. Ask who performs showings, research, offer analysis, drafting, negotiation, condition tracking and backup. The agreement should formalize an informed choice rather than create one by surprise.

If you are still interviewing, say so. A professional can explain services and relationship options without forcing an immediate long exclusive term. Do not provide sensitive financial documents or sign through an unfamiliar link until identity, brokerage and purpose are independently confirmed.

Sign before relying on ongoing advocacy or writing

The practical time to sign is after the relationship and terms are understood but before the professional becomes the buyer's ongoing advocate or prepares an offer as agent. This gives the parties time to define expectations without a property-specific expiry clock. RECA rules require written service agreements for residential representation.

If a desirable Calgary property has just appeared, resist compressing the relationship review into the offer decision. Ask for the agreement and Consumer Relationships Guide separately, read them, complete the material terms and preserve time for legal advice if needed. A rushed signature can affect more than one property.

Define search criteria carefully

The RECA form includes property type and market area search criteria. Review how the proposed wording applies to Calgary districts, surrounding municipalities, new builds, resale homes, condos, detached homes, investment property or a changing price band. Ask whether a property outside the initial portal still falls within the agreement.

The scope should match the service you intend to receive. If the search evolves, update the criteria in writing. Avoid vague language you cannot apply later, and do not assume a private sale, builder contact, open-house visit or property found independently is automatically outside the agreement.

Complete exact start, end and exclusivity terms

Record the precise beginning and ending dates and times. Understand that exclusivity can prevent appointing another agent for the same search criteria during the term. Choose a duration that gives the professional a fair opportunity to work while providing a sensible performance and fit review.

Ask what happens when the buyer pauses, changes area, enters a builder sales centre, works with a relocation service or wants a different agent within the brokerage. Discuss the early-termination clause before signing; goodwill is not a substitute for the contract language.

Write the buyer services and decision method

List the expected services: planning, search setup, listing interpretation, property research, showing access, comparable analysis, resale-risk review, offer options, drafting, negotiation, condition calendar, inspection and document coordination, lender and lawyer handoff, walkthrough and possession support. Identify exclusions and third-party roles.

Ask how the professional will protect a walk-away limit and explain material uncertainties. A buyer needs more than listing alerts and door access. The service plan should show how assumptions about price, condo risk, suite legality, condition, insurance, financing and possession will be assigned to evidence and qualified owners.

Calculate remuneration and a shortfall scenario

Read the remuneration section and ask for dollar examples. Identify the agreed amount, what the brokerage may receive from another source, any credit against the buyer's obligation, GST and when payment is earned. Test a listing where the other-side amount is lower than, equal to or greater than the agreed remuneration.

Include a possible buyer obligation in cash-to-close planning and ask the lender and lawyer how it would be handled in the actual transaction. Do not assume an amount can be financed or that every listing provides the same other-side compensation. Compensation is negotiable before signing.

Ask about represented sellers and competing buyers

A brokerage may represent sellers and other buyers. Ask what happens when you want the brokerage's listing or when another client wants the same property. The response depends on common-law or designated agency structure, the people involved and whether transaction brokerage or another option is appropriate.

Require an explanation of who continues to advocate, what information remains confidential, what written agreement is needed and which alternatives exist. Do not reveal a maximum price, urgency or strategy until you understand who receives and protects the information.

Test early cancellation before you need it

Read the notice method, reimbursable expenses, restrictions on hiring another professional and any obligation tied to introduced properties or a post-expiry period. Ask the brokerage to walk through dissatisfaction, relocation, a search pause, agent departure and a buyer who finds a property independently.

RECA's FAQ says representation agreements are legal contracts and early termination depends on the terms. If a problem later develops, raise it promptly with the agent and broker, preserve deadlines and obtain any release or amendment in writing. Seek Alberta legal advice before breaching overlapping agreements.

Complete, sign and store one final version

Fill every blank, attach service schedules, initial changes and confirm every party signs the same version. Receive the complete signed agreement immediately, together with the Consumer Relationships Guide and any conflict or remuneration disclosure. Record the trusted brokerage contact and broker escalation route.

Save later amendments to criteria, term, agent, services or fees. Before writing an offer, make sure the transaction-specific facts do not require a changed relationship or new disclosure. The agreement is the operating baseline, not a document to forget after setup.

Keep the buyer agreement separate from the offer

The representation agreement governs your service relationship; the purchase contract governs a proposed property transaction. Read and approve each on its own merits. A representation agreement does not guarantee financing, property condition, title, condo health, insurance, appraisal, possession or the success of an offer.

Use the professional relationship to improve those decisions, but retain the correct specialists: lender, Alberta lawyer, inspector, condo-document reviewer, insurer, appraiser or tax professional as needed.
