Determine tax residency before labelling the sale
Section 116 depends on the vendor's tax residency at disposition, not merely citizenship, passport, location of the property, Canadian bank account or a former Calgary address. Record departure and arrival dates, homes, family, ties, treaty position and prior filings for the qualified cross-border advisor.
Do not have the listing or conveyancing team make an unsupported residency conclusion. Put a written residency confirmation deadline before the offer terms are finalized because the contract, certificate and funds process can change materially.
Start the certificate work before closing
CRA permits notification of a proposed disposition and requires notification of an actual disposition within 10 days where the rules apply. Starting after closing can leave the purchaser and lawyers managing statutory exposure while the vendor waits for documents and CRA processing.
Build backward from the proposed possession date through advisor engagement, tax-number confirmation, value evidence, form preparation, document collection, payment or security and purchaser communication. A short closing should not erase the statutory work.
Choose T2062, T2062A or both from the property facts
Form T2062 generally addresses taxable Canadian property held as capital property. T2062A addresses certain real property that is not capital property and depreciable taxable Canadian property, among other categories. CRA procedures note that some dispositions may require both forms.
A Calgary rental sale may contain land and depreciable building, while a development, assignment or inventory position can raise different classification questions. The qualified preparer should identify each form and allocation rather than using the familiar form by default.
Build a complete certificate application package
Collect the accepted or proposed contract, title and ownership shares, acquisition agreement and lawyer statement, legal acquisition costs, improvement records, sale outlays, appraisals or other value evidence, rental statements, CCA schedules, changes of use, principal-residence facts, tax number and signed authorizations.
CRA warns that missing supporting documents delay the certificate. Preserve translations and currency evidence where relevant. Submit personal identifiers only through the secure channel approved by the tax professional and CRA process, never through an ordinary real estate lead form.

Address UHT and prior Canadian compliance
CRA may refuse a section 116 certificate for certain affected non-resident, non-Canadian owners who have not met Underused Housing Tax filing and payment obligations. Determine affected-owner and exemption status for each relevant year rather than assuming no tax payable means no return was required.
Reconcile non-resident rental withholding, NR6 approvals, section 216 returns, CCA and other Canadian filings. An outstanding return or inconsistent ownership fact can affect timing and the final tax result.
Put purchaser protection and withholding in the contract plan
Section 116 protects the purchaser through the certificate and remittance framework. The Alberta lawyer should address vendor residency representations, evidence, holdback, purchaser liability, payment or security, release conditions and what happens if the certificate is not available at closing.
Do not promise the vendor all proceeds on possession or use a generic holdback estimate in marketing. The required amount and release process depend on the form, certificate limit, classification and legal advice.
Keep certificate payment separate from final tax
A certificate of compliance limits the purchaser's exposure for the notified disposition; it does not establish the vendor's final Canadian tax liability. The vendor's return for the disposition year determines the final result, refund or balance after the relevant calculations.
Track payment or security, certificate amount, lawyer holdback, final return, notice of assessment and refund or balance as separate events. Do not treat a certificate payment as a final tax bill or a recoverable amount without professional confirmation.
Coordinate rental sale, CCA and section 216 deadlines
A non-resident rental owner may have capital-gain, business-income, CCA recapture and rental-income filings. CRA's section 216 guidance has specific deadlines where a sold rental had prior CCA. Bring all T776 or section 216 returns and CCA schedules into the sale file.
The section 116 certificate and section 216 return are not substitutes for each other. Assign each form, year, deadline and payment to the qualified preparer and verify completion.
Model currency, debt and cash availability separately
Prepare a transaction net sheet with Canadian-dollar sale proceeds, mortgage and secured-debt payouts, penalties, compensation, legal fees, adjustments, certificate payment or holdback and moving or transfer costs. Add currency conversion and foreign-country advice as separate unresolved items.
A vendor may have substantial equity and still receive limited cash on closing. Do not commit funds to another purchase or transfer until the lawyer and tax professional confirm the certificate and release path.
Create one cross-border closing command sheet
List the vendor and residency conclusion, ownership shares, form pathway, preparer, lawyer, purchaser counsel contact, CRA submission reference, supporting documents, payment or security, UHT status, rental and CCA filings, contract dates, certificate status, final return and release condition. Update it after every material event.
Verify the CPA and Alberta lawyer independently and confirm cross-border experience for the actual countries and entity type. The real estate professional manages market and transaction communication but should not determine residency, withholding or tax liability.
